This Liability Waiver and Release Agreement (“Agreement”) is made and entered into as of the date signed below by the undersigned participant (“Participant”) in favor of WILD JOY GAMES LLC (the “Company”), including its owners, employees, agents, and representatives.
1. ASSUMPTION OF RISK
Participant understands and acknowledges that participation in any activities, events, rentals, or services provided by the Company may involve risks, including but not limited to physical injury, property damage, or other unforeseen hazards. Participant voluntarily assumes all risks associated with participation.
2. WAIVER AND RELEASE OF LIABILITY
To the fullest extent permitted by law, Participant hereby waives, releases, and discharges the Company from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to participation in any activities or use of the Company’s services, whether caused by negligence or otherwise.
3. INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless the Company from any claims, damages, losses, liabilities, or expenses (including attorneys’ fees) arising from Participant’s actions or participation in any activities provided by the Company.
4. MEDICAL TREATMENT
In the event of an injury, Participant authorizes the Company to seek emergency medical treatment and agrees to assume all financial responsibility for any resulting medical expenses.
5. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
6. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
7. ACKNOWLEDGEMENT AND SIGNATURE
By signing below, Participant acknowledges that they have read, understand, and voluntarily agree to the terms of this Liability Waiver and Release Agreement.
